ACER takes over FCR minimum activation period decision for Continental Europe

Continental European national regulatory authorities have referred a disputed balancing rule to ACER: the minimum activation period that frequency containment reserve providers must maintain during the alert state. The referral, published by ACER, was triggered after the NRAs could not agree among themselves (a standard escalation path under the EU electricity regulation framework).

The alert state activates when system frequency deviates beyond normal bounds but before emergency procedures kick in. How long FCR providers must stay available during that window directly affects reserve dimensioning and the costs that TSOs pass to balancing markets. A shorter minimum period lowers the barrier for fast-cycling assets such as batteries; a longer one favours conventional providers with sustained output.

ACER has not yet published a timeline for the decision. Once issued, the ruling will apply across the Continental Europe synchronous area, setting a uniform floor that individual NRAs cannot undercut. Market participants with FCR exposure in Germany, France, Italy, and neighbouring zones should track the consultation process.
